Generally speaking, in Virginia, many times the employer or insurance company will voluntarily pay medical bills and lost wages following a work-related injury. In order to protect your right to continued medical and wage loss benefits, you must file a claim with the Virginia Workers’ Compensation Commission within a fixed time period.

Generally, you must file a claim for benefits within two years of the date of your work accident. For most occupational diseases, you must file a claim within two years of the date a doctor told you that the disease was caused by your work, or within five years of the date of your last exposure, whichever is sooner.
